• ByteDance and TikTok has recently filed a lawsuit against the US government, arguing that the “TikTok ban law” signed by President Joe Biden violates the Constitution.
  • The Biden administration demanded that TikTok cease its operations within the United States and divest itself within 270 days last month.

In the filing submitted to the Washington DC court on May 7, TikTok argued that the ban on national security grounds violates the freedom of expression guaranteed by the Constitution for 170 million Americans.

They stated, “The TikTok ban is clearly unconstitutional.” and objected that “Forced divestiture is not commercially, technically, or legally feasible.”

As TikTok and the US government enter into a full-fledged legal dispute, it is expected to take considerable time for the bill to be enforced.

To contain China

TikTok has stated in a lawsuit that, “For the first time in history, a legislature has created a law permanently and nationwide banning a specific platform.” Referring to it as “A bill silencing 170 million Americans who use TikTok as a means of communication.”

The ban towards TikTok isn’t the only one imposing restrictions on China. On the upcoming May 7, the Biden administration will cancel licenses for companies like Intel and Qualcomm to export the advanced technology to Huawei, as well as AI chip exports.

Lawmakers argue that the Biden administration should take a more proactive stance in safeguarding essential technologies from China.
