The fact
The US Environmental Protection Agency has proposed removing federal minimum public-participation requirements from state and local minor New Source Review programmes under the Clean Air Act. Current rules require permitting agencies to make relevant information available to the public and provide an opportunity to comment before covered permits are issued.
EPA published the proposal on 7 July and closed the comment period on 21 August. If finalised, state and local air agencies could decide whether and how to provide public participation for minor NSR permits. Existing state requirements would remain unless an agency changes them, and federal participation rules for major NSR permits would be unaffected. Data centres are not singled out, but projects using emissions-producing equipment such as backup generators can require minor-source air permits.
The assessment
The proposal would remove a common federal minimum rather than immediately change the timetable for every data-centre permit. The practical effect would depend on what each state or local air agency does next. Agencies could keep their existing notice and comment procedures, shorten them or adopt different requirements.
For developers, that makes the permitting route more dependent on location. A project that needs an air permit for backup generation would have to check the local participation requirements before fixing its approval schedule. Similar equipment could therefore pass through different procedural steps in different jurisdictions. There is not yet evidence that this would make permits faster.
For BTW readers, the important change would come when individual air agencies rewrite their rules. Until then, EPA is proposing to shift discretion, not remove a defined permitting stage from data-centre projects.
What to watch
Watch whether EPA finalises the proposal and which state or local air agencies then revise their minor NSR programmes. Changes to notice periods, hearing requirements or publication procedures would show where permitting has actually changed. Data-centre generator permits processed under revised rules would provide the clearest test of any effect on project timelines.
