  • Apple took a step back in its feud with Epic Games, allowing the popular game Fortnite to be back in the EU app store.
  • The feud between Apple and Epic Games lasted for 4 years and recently concluded, two sides negotiated around the rules.
  • Even if Apple compromised and the tangle got a solution, there still are confidence crisis between Apple and Epic Games about DMA.

OUR TAKE:
Apple’s decision to open the door for Epic Games in Europe reflects the growing pressure on tech giants to comply with antitrust regulations. While this move is a step towards fair competition, it also highlights the challenges Apple faces in maintaining its App Store dominance. The outcome of this feud could shape the future landscape of app distribution.

The legal battle between Apple and Epik Games, lasted for about 4 years, finally went to an end. Epic Games got its permission back to the EU app store, including the famous game Fortnite.

Apple compromised in the tangle with Epic Games and allowed it back to the EU app store.

Surprisingly, tech giant Apple has taken a step back in its ongoing feud with Epic Games, allowing the gaming company to launch its own game store on iPhones and iPads in Europe. This move comes as Apple faced pressure from European regulators to comply with the Digital Markets Act (DMA), which aims to prevent tech giants like Apple and Google from controlling app distribution on iOS and Android devices.

Apple removed Fortnite from its App Store in 2020 after Epic Games violated the iPhone maker’s in-app payment rules as a protest against the company’s 30% commissions on such payments.

However, with the European Union’s deadline looming, Apple decided to yield and allow Epic Games to establish its game store on Apple devices in Europe. It is indeed a success for Epic Games, yet Fortnite remains unavailable in the US’s app store. Epic Games still fell short of its ultimate goal.

But earlier this week, Epic’s European developer account was terminated. Thierry Breton, the EU’s industry chief, revealed that regulators had cautioned Apple over its action. The move to comply with DMA guidelines indicates that Apple is feeling the impact of mounting pressure from regulatory bodies.

“I take note with satisfaction that following our contacts Apple decided to backtrack its decision on Epic exclusion. From Day 2, #DMA is already showing very concrete results!” Breton said on the X social media platform.

The 4 years tangle between Apple and Epic Games finally reached its ends

The ongoing legal dispute between Apple and Epic Games began in 2020 when the gaming firm alleged that Apple’s practice of charging up to 30% commissions on in-app payments on its iOS devices violated U.S. antitrust rules. Despite losing the court battle against Apple, Epic Games intentionally broke Apple’s rules, resulting in their ban from Apple’s devices.

While Apple’s decision to reinstate Epic Games’ developer account is a positive development, it is clear that Apple is facing challenges to its App Store business model. The company is grappling with the potential erosion of its market dominance and revenue streams, particularly as it anticipates lower-than-expected iPhone sales this quarter.

Epic Games hasn’t reached its final goal, confidence crisis with Apple still exists

Epic Games CEO, Tim Sweeney, has criticized Apple’s compliance plans with the DMA, emphasizing that Apple should not have the right to exclude third-party app marketplaces under certain circumstances. This highlights the ongoing tension between the two companies, even in the wake of this latest development.

As the tech industry continues to evolve, regulatory scrutiny on major players like Apple and Google is increasing. The DMA represents a larger global effort to establish fair competition standards and limit the control wielded by tech giants over app distribution.

“Following conversations with Epic, they have committed to follow the rules, including our DMA policies. As a result, Epic Sweden AB has been permitted to re-sign the developer agreement and accepted into the Apple Developer Program,” Apple said in a statement.
