    • The FCC has proposed a $6 million fine for a scammer who used AI to clone President Biden’s voice in illegal robocalls.
    • The $6 million fine proposed by the FCC sets a precedent for financial penalties in AI-related illegal activities, although the actual amount paid may be lower due to legal and procedural factors.

The FCC has proposed a $6 million fine for Steve Kramer, a political consultant who used AI voice-cloning technology to impersonate President Biden in a series of illegal robocalls during the New Hampshire primary election. The FCC’s action serves as a warning to other potential high-tech scammers, emphasising that the misuse of AI for voter suppression or fraud will be met with swift and decisive enforcement.

    Financial penalties and limitations

The $6 million fine proposed by the FCC represents a significant financial penalty, although the actual amount paid is often lower due to various legal and procedural factors. This fine sets a precedent for the financial repercussions of using AI technology in illegal activities, underscoring the FCC’s role in regulating and penalizing such actions. The ongoing investigations and potential penalties against Lingo and other involved entities further illustrate the regulatory challenges and the importance of robust enforcement mechanisms.

    Regulatory impact

Following the Biden voice-cloning case, the FCC officially declared AI-generated voices illegal for use in robocalls in February. This regulatory decision clarifies that AI-generated voices fall under the category of “artificial” elements prohibited in such communications. The ruling is a critical step in addressing the evolving landscape of AI technology and its potential for misuse.
